Prosecutors call for ‘Rust’ film gunsmith to be sentenced to up to 18 months in prison

Prosecutors in the case against gunsmith “Rust” Hannah Gutierrez Reed are asking that she be sentenced to 18 months in prison – the maximum sentence in the manslaughter charge she was convicted of – arguing that she demonstrated a “complete and utter failure to accept responsibility.” for his actions,” according to a court document filed Friday.

Gutierrez Reed was convicted of manslaughter in March in connection with the death of cinematographer Halyna Hutchins. Hutchins was killed in October 2021 by a live round fired from a prop gun held by actor Alec Baldwin on the set of “Rust.” She was also acquitted of a separate charge of tampering with evidence.

Gutierrez Reed, who was responsible for gun security and storage on the set of the film, is expected to be sentenced Monday. In addition to receiving the maximum prison term, Gutierrez Reed also faces a $5,000 fine as part of his sentence.

She was the first person to go to trial in a case highlighting the film industry’s safety standards — and this specific set’s violations of them. During the trial, prosecutors argued that Gutierrez Reed repeatedly violated on-set safety protocol and acted negligently and without caution while performing his duties as a gunsmith, and that his actions ultimately led to Hutchins’ death.

Like Gutierrez Reed, Baldwin, who held the gun, now faces a manslaughter charge in Hutchins’ death.

New Mexico special prosecutors recently alleged that Baldwin’s behavior on set contributed to the “security compromises” that led to the fatal shooting. The complaint followed Baldwin’s team’s request in March to dismiss the indictment against him.

In January, Baldwin pleaded not guilty to manslaughter in the shooting.

In a sentencing memorandum filed earlier this week, Gutierrez Reed’s attorney requested parole because she had no criminal history and had a “record of prior good works.”

CNN has requested comment from Gutierrez Reed’s attorney.

The special prosecutor’s office cited summaries of some of his jail calls as one reason why Gutierrez Reed should get the maximum sentence.

In the appeals, prosecutors say she blamed Hutchins’ death on the doctor and paramedics and claimed the judge and the special prosecutor’s office conspired against her, while calling jurors derogatory names. Based on the timeline of one of the jail calls, special prosecutors also suspect Gutierrez Reed of drinking alcohol, which would have constituted a violation of his release, they said.

CNN has requested the full transcripts and recordings of the calls from the prosecutor’s office.

Gutierrez Reed also faces an unrelated charge of unlawfully carrying a firearm in a licensed alcohol establishment after he brought a gun into a bar and then filmed a video about it in a restroom, the court filing states. The case is still pending, according to court records.
